How can you protect child's mental health records from a biological parent who is the abuser? Oklahoma


How can you protect child's mental health records from a biological parent who is the abuser? Oklahoma?
My child went to a psychologist to get help with mood disorders. The Dr. further decided that she is suffering from PTSD and Clinical Depression/Anxiety r/t emotional/verbal abuse from the father. The Dr turned this into DHS for investigation. Well that is going on along with court stuff.. well abuser dad has gone to the same Dr listed on the court paperwork and "demanded" the paperwork. EVERYTHING in the file. Notes tests, everything.. the freaking DR is going to give all of it to him.. Is there any laws to protect children from the abuser in OK? I know HIPAA has many regulation and states "professional judgement" repeatedly. DR says OK law over rides that.. not sure how ?? Question is what/ where can I find rights for the child. the whole record is negative to him and he still gets visitation until court. so this puts her in further harm and the DR is ok with this they said.. Please any suggestions .. Help I am at a Loss!!

If the biological father still has parental rights then he is allowed access to the child's medical information under HIPAA. The only way to prevent this would be for you to hire a lawyer who practices Family Law and try to terminate his parental rights; if he really is an abuser then that wouldn't be too difficult a case to make.
